Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the Maevn AI Shopify application (the "App"), you ("Merchant," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. Description of Service

Maevn AI provides an AI-powered sales optimization tool for Shopify stores. The App:

  • Monitors anonymous visitor browsing behavior (with consent) to identify purchase intent signals.
  • Uses AI (Claude by Anthropic) to generate personalized product bundle recommendations, comparisons, and targeted offers.
  • Displays these recommendations via non-intrusive popups on your storefront.
  • Creates time-limited discount codes through the Shopify Admin API.
  • Provides analytics and performance dashboards within the Shopify admin.

3. Account and Access

  • You must have an active Shopify store to use the App.
  • You authorize Maevn to access your Shopify store data through the scopes requested during installation (product data, discount management, order data).
  • You are responsible for maintaining the security of your Shopify account.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of Shopify's Terms of Service.
  • Attempt to reverse-engineer, decompile, or extract the source code of the App.
  • Interfere with or disrupt the App's infrastructure or services.
  • Use the App to collect personal data beyond what is necessary for its functionality.
  • Resell, sublicense, or redistribute the App without our written consent.

5. AI-Generated Content

Maevn uses AI to generate product recommendation copy, comparison pitches, and discount messaging. While we strive for accuracy:

  • AI-generated content may occasionally contain inaccuracies or unexpected phrasing.
  • You are responsible for reviewing the campaigns and recommendations shown on your store.
  • You can pause or deactivate campaigns at any time through the App dashboard.
  • Maevn is not liable for any loss resulting from AI-generated content displayed on your store.

6. Discounts and Pricing

  • The App creates discount codes on your Shopify store based on the parameters you configure (discount percentage, duration, etc.).
  • You are solely responsible for the financial impact of discounts created through the App.
  • Maevn automatically cleans up expired discount codes but is not responsible for any discounts that remain active due to technical issues.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect data. By using the App, you also agree to the terms of the Privacy Policy.

8. Intellectual Property

The App, including its code, design, AI models, and branding, is the intellectual property of Maevn AI. Nothing in these Terms grants you ownership of any part of the App. Your store data remains your property at all times.

9. Service Availability

  • We strive for high availability but do not guarantee 100% uptime.
  • The App depends on third-party services (Shopify API, Anthropic API, hosting infrastructure) that may experience downtime.
  • We will make reasonable efforts to notify you of planned maintenance.
  • The App includes fallback mechanisms (heuristic-based recommendations) that activate when AI services are temporarily unavailable.

10. Limitation of Liability

To the maximum extent permitted by law, Maevn AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the App.
  • Any unauthorized access to or alteration of your data.
  • Any AI-generated content or recommendations provided through the App.
  • Any discounts created or applied through the App.

11. Termination

  • You may terminate your use of the App at any time by uninstalling it from your Shopify store.
  • We may suspend or terminate your access if you violate these Terms.
  • Upon termination, we will delete your data in accordance with our Privacy Policy (within 30 days).

12. Changes to Terms

We may update these Terms from time to time. We will notify merchants of material changes through the App dashboard or via email. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.
